Sakaja Back In Court To Stop IEBC From Removing His Name from Ballot Papers

Sakaja moves to court to stop IEBC from revoking his clearance certificate

Embattled Nairobi United Democratic Alliance (UDA) gubernatorial hopeful Johnson Sakaja has moved to court seeking to compel the Independent Electoral and Boundaries Commission (IEBC) from revoking his clearance certificate before the case challenging his academic credentials is heard and determined by the high court.

According to the case filed on 08th July 2022, Sakaja dismissed the Commission for University Education (CUE) decision to revoke the recognition of his Bachelor of Science in Management (External) degree certificate from Team University, Uganda as unconstitutional and illegal and thereby compelling the court to quash and thwart that case challenging the validity of his degree certificate.

A declaration that the decision by the respondent made on 29th June 2022 revoking the recognition of the petitioner’s degree from Team University is invalid, unfair, unconstitutional and illegal hence the same be and is hereby quashed” reads part of the case.

Sakaja also sought the high court to compel the Independent Electoral and Boundaries Commission (IEBC) from striking his name from the list of contenders for the Nairobi gubernatorial seat.

“An order barring the Independent Electoral and Boundaries Commission (IEBC) herein from removing the petitioner as a candidate for governor Nairobi city county in forthcoming election” letter noted.

This emerges after Team University moved to the Ugandan court seeking to stop National Council for Higher Education (NCHE) and Inspectorate Government (IG) from probing into Sakaja’s degree certificate saga.

However, NCHE stopped the investigation following the move by IG to take up the matter to investigate into senator’s degree.

“NCHE commenced investigations in order to determine the authenticity of the Bachelor of Science in Management (External) degree awarded to Sakaja Johnson Arthur by Team University. However, prior to completing our investigations, the IG also began investigations into the same matter hence suspending our action,” said NCHE executive director Prof Mary Okwakol.

Sakaja was reprieved after the Ugandan court heeded Team University’s appeal and directed the Investigating bodies into Senator’s degree to stop until the case is heard and determined.
