Katiba Institute has returned to the High Court in a fresh bid to enforce court orders related to the construction of an Ebola treatment facility in Laikipia County.
The organization is seeking to have Attorney General Dorcas Oduor and Health Cabinet Secretary Aden Duale cited for contempt of court over what it describes as failure to comply with directives issued by the court on May 28 and June 2, 2026.
In an application filed before the High Court, Katiba Institute, through its lawyer Malidzo Nyawa, argues that the two senior government officials have not obeyed orders that were previously issued concerning the controversial health project. The organization maintains that the court’s directives were clear and should have been followed within the required timelines.
The institute is now asking the court to formally find both the Attorney General and the Health Cabinet Secretary in contempt. It argues that their alleged failure to comply with the orders amounts to disregard for the authority of the court and undermines the rule of law. If the court agrees with its position, Katiba Institute wants appropriate penalties imposed against the officials.
In addition to the contempt proceedings, the organization is seeking a conservatory order that would require the respondents to provide a detailed report or affidavit on the status of the Ebola treatment facility.
The report would be expected to explain the current stage of construction and outline the measures that have been taken to comply with the court’s earlier directives.
According to the application, such a report would help the court determine whether its orders have been followed. It would also provide greater transparency regarding a project that has attracted considerable public attention and legal scrutiny in recent months.
The dispute over the planned Ebola treatment facility has generated debate and legal challenges, making it one of the closely watched public interest cases currently before the courts. With the latest application, the focus has now shifted to whether senior government officials complied with judicial orders and whether any sanctions should follow if non-compliance is established.
