Democracy for the Citizens Party official Dr Peter Mbae has announced that lawyers have issued a demand letter to Mbeere North MP Njeru Leo Wa Muthende over allegations linked to a robbery with violence incident that is said to have taken place in Ol Kalou on July 16.
Mbae, who is a close ally of former Deputy President Rigathi Gachagua within DCP, shared the information through his official Facebook page, saying the party is prepared to move to court if the matter is not resolved.
According to Mbae, the demand centers on the return of an iPhone 17 Pro Max that is alleged to have been taken during the incident. He stated that if the phone is not returned, legal action will be pursued against the legislator.
The demand letter, dated July 24, 2026, was written by Muge Law Advocates on behalf of Wanjiku Mwihaki. The lawyers state that their client reported the matter at Ol Kalou Police Station on the same day the alleged incident occurred.
According to the letter, the events took place on July 16 during the Ol Kalou parliamentary by-election. The lawyers claim that Wanjiku Mwihaki and another woman were near Mathakwa Primary School Polling Station in Mirangine Ward when they were confronted by armed men travelling in a convoy of Toyota Prado vehicles.
The letter further alleges that MP Njeru Leo Wa Muthende stepped out of one of the vehicles and remained at the scene throughout the incident.
It claims that armed and hooded security officers accompanying him allegedly held the complainant at gunpoint before taking away her iPhone 17 Pro Max while he was present.
The lawyers also allege that the same group later attempted to force the complainant and her companion into one of the vehicles. However, they claim the two women resisted and managed to prevent the alleged abduction from taking place.
In the letter, Muge Law Advocates argue that the circumstances described meet the legal requirements for the offence of robbery with violence under Sections 295 and 296 of the Penal Code.
They have demanded that the phone be returned in good working condition within seven days of receiving the letter. If that is not possible, they want a replacement device or payment of KSh 300,000 as compensation.
The lawyers are also demanding that the identities of the officers who allegedly participated in the robbery and attempted abduction be disclosed. Copies of the demand letter were sent to the Directorate of Criminal Investigations, the Independent Policing Oversight Authority, the Independent Electoral and Boundaries Commission, and the Speaker of the National Assembly.
The allegations have emerged as political temperatures remain high following the disputed Ol Kalou parliamentary by-election. At the time of the demand letter, the claims remained allegations contained in the legal correspondence, and it was not immediately clear whether MP Njeru Leo Wa Muthende or his representatives had responded to the accusations.
