An open letter has called on the Ethics and Anti-Corruption Commission (EACC), the Directorate of Criminal Investigations (DCI), the Office of the Auditor-General and the Public Procurement Regulatory Authority (PPRA) to launch independent investigations into alleged conflicts of interest and procurement irregularities in Mukurweini Constituency, Nyeri County.

The letter specifically highlights lorry registration number KDW 434K, which is alleged to be owned by Susan Kaguchia, wife of Mukurweini Member of Parliament Hon. John Kaguchia. According to the concerns raised, the vehicle was reportedly awarded tenders to supply murram for several constituency projects. These include works on Kangurwe Wachee Road, Gathuki Mudu Primary School, Thangathi Primary School and other local initiatives funded through public resources.

The authors of the letter have asked the relevant agencies to examine ownership records of the lorry, the processes used to award the tenders, any possible conflicts of interest arising from the family relationship, compliance with Kenya’s public procurement laws, and whether public funds were properly utilised. They stress that the matters raised remain allegations and have not been established as fact.

“We emphasize that these are allegations requiring independent verification, not established findings of wrongdoing,” the letter states. “We therefore request a fair, transparent and impartial investigation, free from political interference.”

The call underscores growing public demand for accountability in the management of constituency development funds and related projects. Residents and oversight advocates have repeatedly pressed for clearer separation between elected leaders’ personal or family interests and the award of public contracts. In this case, the alleged involvement of a vehicle linked to the MP’s spouse has fuelled questions about whether due process was followed and whether the principles of fairness, competition and value for money were upheld.

Investigators would need to establish several concrete facts. First, the true ownership of lorry KDW 434K through official records held by the National Transport and Safety Authority and related registries. Second, the tender evaluation and award documents for the listed projects to determine how the supplier was selected. Third, whether any declaration of interest was made by the MP or related parties, as required under public officer ethics and procurement legislation. Fourth, the quality and quantity of murram delivered and whether payments matched contractual terms and market rates.

The letter further notes that Mukurweini constituents deserve clear answers and that transparency must guide any inquiry. Should evidence of violations emerge, the authors insist that the law must apply without fear or favour.

Public procurement remains one of the most scrutinised areas of county and national government expenditure. Past audits by the Auditor-General have frequently flagged weaknesses in documentation, single-sourcing and potential conflicts in similar local projects across the country.

The current call places the spotlight firmly on Mukurweini and tests the responsiveness of Kenya’s anti-corruption and oversight institutions.

The agencies addressed in the letter now face the task of determining whether a formal probe is warranted and, if so, of conducting it in a manner that maintains public confidence in both the process and the outcome.
