High Court Judge Alfred Mabeya Accused of Destroying Businesses with Unlawful Rulings

High Court Judge Alfred Mabeya is in the spotlight, and not in a good way.

According to blogger Cyprian Nyakundi’s post on X on December 18, Cytonn CEO Edwin Dande has filed a formal petition with the Judicial Service Commission (JSC) accusing the judge of misconduct, bias, and questionable rulings that have left businesses and individuals reeling.

In the petition, Dande lays out serious claims against Justice Mabeya, focusing on his handling of insolvency cases. According to Dande, Mabeya has issued liquidation orders out of thin air—orders that no one even asked for.

He’s also accused of inferring fraud without evidence and condemning businesses or individuals who weren’t even part of the court proceedings.

But it doesn’t stop there. The petition accuses Mabeya of outright defiance of the Court of Appeal.

Apparently, he’s been ignoring stay orders, allowing cases under appeal to move forward as though nothing happened. If true, this is a direct violation of the judicial process and a slap in the face to judicial hierarchy.

Then there’s the alleged game-playing with case files. Dande claims that Mabeya deliberately delayed releasing files after delivering rulings, making it impossible for parties to file appeals on time.

These delays, he says, point to shady dealings involving officials at the Official Receiver’s Office and the Company Registry—people allegedly working behind the scenes to dismantle businesses trying to protect themselves under the Insolvency Act.

And let’s not forget the accusations about Mabeya’s attitude in court. The judge allegedly referred to applications challenging his rulings as “bloody applications” and made dismissive comments about higher courts.

That kind of behavior raises serious questions about professionalism and judicial temperament.

Dande is now urging President William Ruto to set up a tribunal to investigate Mabeya’s conduct and determine if he’s fit to remain on the bench.

In a public statement, Dande didn’t mince words. “These contrived decisions must end,” he said, stressing the need to protect the judiciary’s integrity.

For now, all eyes are on the JSC and the president. Will they act, or will these allegations be swept under the rug?
